Digital Advertising & Analytics Policy

Last Updated: January 1, 2026

This Digital Advertising & Analytics Policy (this “Policy”) is issued by Z Natural Foods LLC (“ZNF,” “we,” “us,” or “our”), a Florida company operating from West Palm Beach, Palm Beach County, Florida.

This Policy applies to ZNF’s digital advertising, promotional, audience-building, attribution, measurement, analytics, and related data-driven marketing practices in connection with ZNaturalFoods.com, checkout flows, customer account features, emails, SMS/MMS and other mobile communications, marketplace listings, social-commerce channels, third-party storefronts, customer-service channels, local-pickup-related communications, wholesale/B2B channels, influencer or affiliate campaigns, and other online or technology-enabled services, communications, or channels owned, operated, licensed, controlled, or used by or on behalf of ZNF (collectively, the “Services”).

This Policy is incorporated into and forms part of ZNF’s broader legal framework, including, without limitation, the Terms of Use (“TOU”), Privacy Policy, Cookie Policy, Mobile Terms of Service, Product Review Guidelines, Content Policy, Legal Notice, Disclaimers, Risk Allocation, & Important Consumer / Commercial Disclosures Policy, GDPR Statement / applicable privacy notices, Information Security Policy, and any other applicable ZNF legal policy or notice published on ZNF’s Legal page (collectively, the “ZNF Legal Policies”).

By accessing, using, browsing, placing an order through, interacting with, or otherwise engaging with any Service, you acknowledge that you have read, understood, and agree to be bound by this Policy and the ZNF Legal Policies to the fullest extent permitted by law. If you do not agree, do not use the Services.

Nothing in this Policy is intended to waive, limit, or override any non-waivable right or obligation under applicable law.

This Policy governs, without limitation:

  • digital advertising and promotional practices;

  • analytics, attribution, audience modeling, campaign measurement, and conversion tracking;

  • interest-based advertising, remarketing, retargeting, and similar advertising practices;

  • the use of cookies, pixels, tags, SDKs, web beacons, and similar technologies for advertising or analytics purposes, subject to the more detailed terms of the Cookie Policy;

  • advertising or promotional email communications;

  • advertising or promotional SMS/MMS or similar mobile messaging, subject to the Mobile Terms of Service;

  • advertising, promotion, or measurement conducted on or through third-party platforms, marketplaces, social-media platforms, search engines, ad networks, and service providers.

1.2 Order of Precedence

In the event of a direct conflict:

  • the TOU controls with respect to arbitration, class-action waiver, limitation of liability, governing law, venue, evidentiary rules, survival, and general risk-allocation provisions;

  • the Privacy Policy, Cookie Policy, GDPR Statement, and any applicable privacy-choice or opt-out notice control with respect to privacy disclosures, personal-data practices, privacy rights, cookies, similar technologies, and state or international privacy-choice mechanisms;

  • the Mobile Terms of Service control with respect to SMS/MMS enrollment, consent, opt-out, sender/program mechanics, and other mobile-message-specific rules;

  • the Product Review Guidelines and Content Policy control with respect to review authenticity, user-generated content, incentives, moderation, and content restrictions; and

  • this Policy controls with respect to digital-advertising, attribution, analytics, campaign-measurement, and endorsement-use matters.

1.3 No Expansion of Rights

This Policy provides disclosures and reserves rights; it does not create any guarantee of advertising availability, campaign performance, platform access, review publication, targeting continuity, audience reach, or analytics accuracy.

2.4 “Contextual Advertising”

means advertising displayed based primarily on the content of a page, query, placement, listing, or session rather than on profiling across contexts.

3. Channels and Contexts Covered

This Policy applies, without limitation, to advertising, promotion, analytics, or attribution activities conducted:

  • on ZNaturalFoods.com and any successor domain, subdomain, mobile site, application, account portal, or checkout flow;

  • through shopping-cart, checkout, abandoned-cart, post-purchase, reorder, subscription, local pickup, freight, quote-request, or account-based workflows;

  • through retail/B2C and wholesale/B2B email, text, social, and other messaging channels;

  • through or in connection with telephone, email, chat, support, or sales communications to the extent such interactions include marketing or campaign-related content;

  • on or through third-party marketplaces or storefronts, including, without limitation, Amazon, Walmart, eBay, Etsy, TikTok Shop, Meta/Facebook/Instagram, Google, Pinterest, and comparable or successor platforms;

  • through agencies, ad networks, affiliates, influencers, publishers, review tools, marketing platforms, automation tools, and measurement vendors; and

  • in connection with domestic and international audiences to the extent ZNF elects to market or advertise into those jurisdictions.

4. General Advertising and Analytics Practices

4.1 Use of Advertising and Analytics Tools

ZNF may use one or more Advertising Providers, Analytics Providers, and related tools to:

  • advertise and promote ZNF products, content, and Services;

  • measure traffic, engagement, conversions, purchases, and campaign performance;

  • understand user behavior, site interactions, and purchase paths;

  • build, refine, match, suppress, or segment audiences;

  • support remarketing, retargeting, personalization, campaign optimization, and fraud reduction;

  • evaluate promotional effectiveness, merchandising performance, and customer experience;

  • support customer acquisition, retention, re-engagement, and loyalty efforts; and

  • protect against abuse, unauthorized activity, or commercially unreasonable conduct.

4.2 Use of Multiple Data Sources

Advertising and analytics activities may rely on information collected directly from users, automatically through technology, or from third-party providers, service providers, platforms, marketplaces, carriers, processors, or other lawful sources, subject always to the ZNF Legal Policies and applicable law.

4.3 No Guarantee of Analytics Precision

Attribution models, tracking systems, campaign reports, and measurement outputs are inherently imperfect and may be incomplete, delayed, estimated, sampled, deduplicated, or inconsistent across platforms, devices, sessions, or providers. ZNF does not warrant that any attribution or analytics report is complete, error-free, or suitable for any particular legal, commercial, tax, accounting, or business purpose.

4.4 Correction; Suspension; Withdrawal

ZNF reserves the right, in its sole discretion and at any time, to revise, replace, reject, suspend, withdraw, geoblock, de-index, or discontinue any advertisement, campaign, tag, tracking configuration, targeting practice, offer, platform relationship, review excerpt, testimonial use, or analytic process, with or without notice, where ZNF believes legal, regulatory, privacy, platform, carrier, marketplace, reputational, operational, cybersecurity, fraud, or litigation risk may exist.

5. Cookies, Pixels, Tags, SDKs, and Similar Technologies

5.1 Relationship to Cookie Policy

ZNF may use Cookies and Similar Technologies for advertising, attribution, measurement, analytics, personalization, fraud prevention, and related purposes. Additional information regarding such technologies, preference mechanisms, browser controls, consent tools, Global Privacy Control signals where recognized, and certain state-law privacy choices is provided in the Cookie Policy, Privacy Policy, GDPR Statement, and any applicable Your Privacy Choices / Data Sharing Opt-Out notice.

5.2 Device-, Browser-, and Context-Specific Treatment

Where applicable, certain opt-outs, browser controls, privacy signals, or consent choices may apply only to the specific device, browser, app, session, or context in which they are exercised. ZNF does not guarantee that a single privacy choice will automatically apply across all devices, browsers, marketplaces, channels, or third-party platforms unless applicable law expressly requires otherwise and the relevant systems support such application.

5.3 Third-Party Technologies

Third-party platforms or providers may place, read, receive, or process Cookies and Similar Technologies subject to their own terms, notices, technical capabilities, and privacy practices. ZNF does not control all third-party cookies, tags, or similar technologies and disclaims responsibility for third-party practices to the fullest extent permitted by law.

6. Truth in Advertising; Claim Substantiation; Health-Related Restrictions

6.1 General Standard

ZNF intends for advertising and promotional materials disseminated by or on behalf of ZNF to be administered in a manner designed to be truthful, non-deceptive, and consistent with applicable law, including, as applicable, the Federal Trade Commission Act, 15 U.S.C. §§ 45 and 52, the CAN-SPAM Act, 15 U.S.C. §§ 7701–7713, the Telephone Consumer Protection Act, 47 U.S.C. § 227, applicable FCC rules, the Florida Deceptive and Unfair Trade Practices Act, Fla. Stat. § 501.204, the Florida Telephone Solicitation Act, Fla. Stat. § 501.059, and applicable state privacy and consumer-protection laws.

6.2 No Deceptive or Unsubstantiated Advertising

ZNF may refuse, remove, revise, qualify, or discontinue any advertisement, claim, statement, depiction, review excerpt, endorsement, influencer statement, or campaign element that ZNF determines, in its sole discretion, may be:

  • false, unfair, deceptive, misleading, or materially incomplete;

  • likely to mislead by express statement, implication, omission, net impression, imagery, context, sequencing, juxtaposition, targeting, or testimonial use;

  • not adequately substantiated for the claim conveyed;

  • inconsistent with product labeling, the Legal Notice / Disclaimer Policy, the Content Policy, the Product Review Guidelines, or other ZNF Legal Policies;

  • likely to create food, supplement, drug, medical, disease, safety, efficacy, purity, origin, contaminant, certification, or regulatory risk; or

  • otherwise commercially or legally unreasonable for ZNF to disseminate or continue disseminating.

6.3 Health-Related and Product-Related Restrictions

Because ZNF markets foods, food ingredients, botanicals, powders, extracts, blends, and related products, and because such products may present heightened regulatory and advertising risk, ZNF may reject, remove, or refuse any advertising or promotional content that, expressly or by implication:

  • states or suggests that a product diagnoses, treats, cures, mitigates, or prevents a disease or medical condition unless expressly authorized by law and by ZNF in writing;

  • overstates or mischaracterizes scientific support, testing, purity, safety, dosage, efficacy, absorption, bioavailability, detoxification, hormone effects, weight-loss effects, or other product outcomes;

  • implies that anecdotal experiences, testimonials, or review content constitute scientific proof or typical consumer results;

  • implies that any governmental or quasi-governmental body has approved, certified, or endorsed a product, advertisement, review, or claim when that is not strictly accurate and lawfully supportable;

  • misstates or exaggerates organic status, origin, certifications, lab testing, contaminants, allergens, regulatory status, or comparative advantages; or

  • conflicts with applicable law or the ZNF Legal Policies.

6.4 Net Impression; Implied Claims

ZNF may evaluate advertisements and promotional materials based on the overall net impression created by text, images, audio, sequencing, placement, targeting, and context, and not solely on isolated words or disclaimers. ZNF reserves the right to interpret and manage advertising risk based on the overall message reasonably conveyed to consumers.

6.5 No Waiver by Publication

Publication, delivery, syndication, or temporary availability of any advertisement, offer, campaign, review excerpt, or promotional content shall not be construed as a representation that such content is error-free, permanently approved, or immune from later correction, withdrawal, qualification, or enforcement action.

7. Reviews, Testimonials, Endorsements, Influencers, and User-Generated Content in Advertising

7.1 Use of Endorsement-Type Content

Subject to applicable law and the ZNF Legal Policies, ZNF may solicit, display, quote, excerpt, repost, republish, syndicate, summarize, or otherwise use reviews, ratings, testimonials, endorsements, survey responses, user-generated content, and influencer or creator content for advertising, merchandising, social proof, educational, promotional, or related purposes.

7.2 Governing Standards

Any review, testimonial, endorsement, influencer content, or similar material used in advertising or promotion must comply with:

  • this Policy;

  • the Product Review Guidelines;

  • the Content Policy;

  • the Legal Notice / Disclaimer Policy;

  • applicable platform rules;

  • applicable law concerning endorsements, incentives, testimonials, and deceptive practices.

7.3 Material Connections; Incentives

Where required by applicable law, material connections must be clearly and conspicuously disclosed. ZNF may refuse to publish, continue displaying, or reuse any review, testimonial, endorsement, or influencer content where compensation, incentives, discounts, free products, employment relationships, affiliate arrangements, ambassador relationships, or other material connections are absent, inadequately disclosed, misleadingly presented, or otherwise legally risky.

7.4 No Guaranteed Typicality

Unless expressly and lawfully stated by ZNF with adequate substantiation, no review, testimonial, endorsement, or influencer statement should be interpreted as describing typical results, guaranteed outcomes, or ordinary consumer experience.

7.5 No Obligation to Publish or Reuse

ZNF is under no obligation to publish, republish, retain, syndicate, or continue using any review, testimonial, or endorsement. To the fullest extent permitted by law, ZNF may moderate, redact, abbreviate, summarize, remove, refuse, or stop using any such content at any time.

7.6 Honest Review Rights Preserved

Nothing in this Policy is intended to prohibit or restrict lawful, truthful, good-faith consumer reviews protected by applicable law, including the Consumer Review Fairness Act. However, ZNF may remove, reject, or decline to use content that is fake, deceptive, unlawfully incentivized, abusive, threatening, medically noncompliant, privacy-invasive, extortionate, or otherwise inconsistent with applicable law or the ZNF Legal Policies.

8. Email Marketing

8.1 Promotional vs. Transactional Content

ZNF may send both:

  • Marketing Communications by email, including promotions, product announcements, newsletters, reminders, campaigns, cross-sell or upsell offers, and similar content; and

  • Transactional or Relationship Communications by email, including order confirmations, shipping notices, account notices, fraud or security alerts, recall or safety notices, and other operational or relationship-related messages.

8.2 Commercial Email Compliance

ZNF intends for commercial email communications to be administered in a manner designed to comply with applicable law, including the CAN-SPAM Act and applicable state-law requirements. ZNF may maintain suppression lists, campaign logs, and related compliance records for that purpose.

8.3 Opt-Out Scope

Opting out of promotional or marketing emails will not necessarily prevent ZNF from sending transactional, relationship, account, security, recall, safety, legal, or other non-promotional communications that ZNF is otherwise legally permitted to send.

8.4 B2B Communications

To the fullest extent permitted by law, this email section applies to both consumer-facing and B2B or wholesale-oriented marketing communications.

9. Mobile Marketing; SMS/MMS; Similar Messaging

9.1 Relationship to Mobile Terms

Any advertising, promotional, or campaign-related use of SMS, MMS, or similar mobile messaging is additionally governed by ZNF’s Mobile Terms of Service, applicable carrier and platform rules, and applicable federal and state law.

9.2 Consent and Revocation

Enrollment, consent, revocation, sender/program mechanics, HELP/STOP or similar commands, evidence of consent, and message-category treatment are governed by the Mobile Terms of Service and applicable law.

9.3 Transactional vs. Promotional Mobile Messages

An opt-out from promotional mobile messages does not necessarily apply to transactional, relationship, account, security, support, recall, pickup, delivery, or similar operational messages that ZNF is otherwise legally permitted to send.

9.4 Reservation of Rights

ZNF may limit, suspend, modify, or terminate any mobile-marketing practice, sender stream, campaign, provider relationship, or message program where ZNF determines that legal, carrier, platform, fraud, or operational risk may exist.

10. Privacy Choices; Opt-Outs; State Privacy Rights; Global Privacy Control

10.1 Cross-Reference to Privacy Notices

Information regarding privacy rights, state-specific opt-out rights, certain “sale,” “sharing,” or targeted-advertising choices where applicable, and certain browser-based privacy controls is provided in the Privacy Policy, Cookie Policy, GDPR Statement, and any applicable Your Privacy Choices / Data Sharing Opt-Out notice.

10.2 Scope Limitations

Opt-outs and privacy choices may be limited by law, technical feasibility, browser settings, device settings, platform architecture, cookie lifespan, consent state, session state, or the distinction between first-party and third-party systems.

10.3 No Guarantee of Universal Propagation

ZNF does not guarantee that a preference exercised on one browser, device, or platform will automatically propagate to all other browsers, devices, channels, accounts, or third-party environments unless required by law and technically supported.

11. Third-Party Platforms, Marketplaces, Networks, and Service Providers

11.1 Third-Party Environment

ZNF may advertise, promote, list products, measure campaign performance, or otherwise interact through third-party platforms and service providers. Such third parties may operate under their own terms, privacy notices, advertising policies, ranking systems, review systems, moderation standards, technical limitations, and data practices.

11.2 No Control Over Third-Party Systems

To the fullest extent permitted by law, ZNF does not warrant, represent, or guarantee:

  • that a third-party platform will accept, display, rank, deliver, measure, or continue any ZNF advertisement, listing, review, campaign, or creative;

  • the accuracy or completeness of third-party reporting, analytics, attribution, or audience tools;

  • uninterrupted access to any platform, account, marketplace, or advertising inventory;

  • the legality, security, moderation decisions, privacy practices, or performance of any third-party platform or service provider; or

  • that third-party opt-out, consent, targeting, or suppression tools will function in any particular way.

11.3 Provider Monitoring; No Contracting Away Responsibility

ZNF may engage third parties to assist with advertising, analytics, email, mobile messaging, or review-related services. ZNF may monitor, audit, instruct, restrict, or terminate such providers in its discretion. However, no use of a third party shall be construed as a waiver of ZNF’s rights or a concession that ZNF controls all third-party actions, systems, or outcomes.

12. Audience Building, Matching, Personalization, and Suppression

12.1 Audience and Suppression Practices

Where lawful and operationally supported, ZNF may create, refine, use, or suppress audiences for advertising, re-engagement, loyalty, campaign analysis, fraud reduction, legal compliance, or operational integrity.

12.2 Lawful Limitations

ZNF may decline to use certain targeting criteria, audience combinations, inferred characteristics, or sensitive categories where ZNF determines that legal, privacy, regulatory, reputational, or platform risk may exist.

12.3 No Right to Targeting Continuity

No user, customer, vendor, affiliate, influencer, or third party has any right to continued inclusion in or exclusion from any audience, campaign, targeting segment, suppression list, personalization model, or promotional workflow.

13. Offers, Promotions, Pricing Signals, and Campaign Errors

13.1 General Principle

Advertisements, promotions, offers, pricing references, comparative claims, discounts, campaigns, and related materials may be displayed across multiple channels and may vary by platform, geography, device, audience, timing, account, availability, checkout state, inventory, legal restrictions, and other factors.

13.2 Errors and Corrections

ZNF reserves the right to correct, revise, withdraw, or refuse any advertising or promotional content containing errors, inaccuracies, outdated information, platform-feed issues, syndication errors, coupon issues, pricing mistakes, time-zone issues, inventory mismatches, reference-price issues, or other mistakes, to the fullest extent permitted by law and consistently with the ZNF Legal Policies.

13.3 Platform Variance

Content appearing through search engines, caches, feeds, syndicators, affiliates, marketplaces, screenshots, social shares, or third-party ad previews may be delayed, incomplete, or inaccurate. Only the terms actually presented by ZNF at the relevant point of transaction formation control, subject to applicable law.

14. International Advertising; Jurisdictional Limits

14.1 U.S.-Centered Operations

ZNF operates primarily from the United States. Although ZNF may advertise or sell into other jurisdictions, ZNF does not represent that every advertisement, campaign, communication, or tracking practice is available, appropriate, or lawful in every jurisdiction.

14.2 Geographic Restriction Rights

ZNF may, in its sole discretion, suppress, geoblock, localize, modify, refuse, or discontinue any campaign, communication, offer, audience, or tracking practice where compliance is uncertain, technically infeasible, commercially unreasonable, or otherwise undesirable from a legal or operational perspective.

14.3 User Responsibility Outside the U.S.

Persons accessing or interacting with the Services from outside the United States do so at their own risk and remain responsible for local compliance obligations applicable to their own conduct, advertising practices, resales, republication, or use of ZNF content.

15. Recordkeeping; Evidence Preservation; Investigations; Cooperation

15.1 Compliance and Business Records

ZNF and its service providers may preserve and use records relating to advertising, analytics, consent, opt-out status, suppression status, campaign activity, review provenance, audience use, platform notices, email logs, messaging logs, attribution reports, screenshots, complaints, disputes, and related materials for legal, operational, security, accounting, fraud-prevention, audit, evidentiary, and compliance purposes.

15.2 Investigations

ZNF may investigate suspected fraud, abuse, deceptive review activity, undisclosed material connections, false endorsements, unlawful scraping, ad-tech misuse, privacy abuse, opt-out abuse, platform violations, chargeback-linked abuse, or other conduct that ZNF determines may affect its rights, customers, operations, or legal posture.

15.3 Cooperation With Third Parties and Authorities

ZNF may cooperate with service providers, platforms, carriers, payment processors, marketplace operators, advisors, regulators, law enforcement, and other third parties where ZNF determines such cooperation is necessary or appropriate to administer campaigns, respond to complaints, preserve evidence, enforce rights, comply with law, or reduce risk.

16. No Warranty; Limitation of Responsibility; Reliance Disclaimer

16.1 No Warranty

To the fullest extent permitted by law, ZNF disclaims all warranties, express, implied, and statutory, concerning:

  • the availability, timing, delivery, reach, ranking, placement, approval, performance, or continuity of any advertisement, campaign, email, message, review display, or platform relationship;

  • the completeness, accuracy, timeliness, or legal sufficiency of third-party reports, attribution outputs, metrics, or analytics;

  • the uninterrupted functioning of third-party opt-out, suppression, privacy, or targeting tools;

  • the publication, persistence, or removal of any review, testimonial, endorsement, or social proof; and

  • the suitability of any advertising, analytics, or attribution output for business, legal, regulatory, accounting, tax, or evidentiary use.

16.2 No Professional Advice

Nothing in any ZNF advertisement, campaign, promotional message, review excerpt, testimonial, influencer statement, or analytics report constitutes legal, medical, nutritional, scientific, tax, customs, or other professional advice. All broader informational and professional-advice disclaimers in the ZNF Legal Policies remain fully applicable.

16.3 Limitation of Liability

All limitations of liability, damages exclusions, liability caps, and related risk-allocation provisions in the TOU and other applicable ZNF Legal Policies apply fully to this Policy and to all disputes, claims, investigations, or liabilities arising out of or relating to digital advertising, analytics, reviews, endorsements, email, mobile messaging, privacy choices, attribution, or related matters.

17. Governing Law; Arbitration; Class Waiver; Venue; Survival

17.1 Governing Law

This Policy shall be governed by and construed in accordance with the laws designated in the TOU, including Florida law and the Federal Arbitration Act to the extent applicable, without regard to contrary conflict-of-law principles except as otherwise required by non-waivable law.

17.2 Binding Arbitration; Class Waiver

Any dispute, claim, or controversy arising out of or relating to this Policy, the Services, ZNF advertising or analytics practices, or any related communication, transaction, or interaction shall be resolved exclusively in accordance with the dispute-resolution, arbitration, class-action waiver, and venue provisions of the TOU, to the fullest extent permitted by law.

17.3 Survival

All rights, restrictions, disclaimers, evidence-preservation rights, indemnity-related protections, arbitration provisions, class waivers, limitation-of-liability provisions, and other risk-allocation terms applicable to this Policy shall survive any suspension, discontinuation, deletion, cancellation, opt-out, termination of account, termination of campaign, or cessation of use of the Services.

18. Changes to This Policy

ZNF may modify this Policy at any time by posting an updated version on the applicable Service or Legal page, subject to any notice requirements imposed by applicable law. Unless otherwise required by law, the revised Policy will become effective upon posting or on the effective date stated in the revised version. Continued use of the Services after the effective date of a revised Policy constitutes acceptance of the revised Policy to the fullest extent permitted by law.

19. Final Acknowledgment; Integrated Legal Framework; Questions; Dispute Resolution

Where affirmative consent, opt-in, opt-out, notice, or other specific procedure is required by applicable law, ZNF may rely on the legally required method for that specific context. Nothing in this Policy or any ZNF Legal Policy is intended to waive, limit, restrict, or override any right or obligation that cannot lawfully be waived, limited, restricted, or overridden.

By using, purchasing from, communicating with, submitting to, accessing, or otherwise interacting with ZNF through any channel, you acknowledge that you have had an opportunity to review this Policy, the Terms of Use, and the other ZNF Legal Policies available on the Legal page, and that your relationship with ZNF is governed by the then-current versions of those policies to the fullest extent permitted by applicable law.
